5. Availability of products

The Customer accepts Koinak Art Stock faculty to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the website https://www.koinak.it at the time of the creation of the order and indicated in the e-mail confirmation sent by Koinak Art Stock to the Customer.
In the event of an IT, manual, technical, or any other type of error that could result in a substantial change, not envisaged by Koinak Art Stock, of the retail price, which renders it exorbitant or clearly derisory, the purchase order it will be considered invalid and canceled and the amount paid by the Customer will be refunded within 14 days from the day of cancellation.
8. Delivery

Delivery is from 5 to 7 days, if no delivery date is specified, within the estimated deadline at the time of the selection of the delivery method and, in any case, within the maximum term of 30 days from the date of confirmation.
If it is not possible to make the delivery, the order will be sent to the deposit. In this case, a notice will specify where the order is located and how to arrange a new delivery.
If you are not able to be present at the place of delivery at the agreed time, we ask you to contact us again to arrange a new delivery date.
If the delivery can not take place due to causes not attributable to us after 15 days from the date on which the order is available for delivery, we will assume that we intend to terminate the contract.
As a result of the termination the amounts will be returned, including delivery costs with the exclusion of any additional costs arising from the choice of a method of delivery different from the ordinary method offered without unjustified delay and, in any case, within 30 days from the date of termination of the contract. The transport resulting from the termination of the contract could have additional costs that will be borne by the buyer
Shipping costs are the buyer's responsibility and are explicitly highlighted at the time the order is placed.
9. Passage of risk
The risks related to the products will pass to the buyer from the moment of delivery. The ownership of the products is considered acquired as soon as the full payment of all the amounts due in relation to them has been received, including shipping costs, or at the time of delivery, if this happens at a later time.
10. Warranty and commercial compliance
The seller is responsible for any defect in the products offered on the https://www.koinak.it website, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.
If the purchaser has signed the contract as a consumer, that is, any natural person acting on the https://www.koinak.it site for purposes unrelated to any business or professional activity carried out, this warranty is valid on condition that the defect occurs within 24 months from the date of delivery of the products; that the buyer presents a formal complaint regarding defects within a maximum of 2 months from the date on which the defect was acknowledged by the latter; that the online return form is completed correctly.
In case of non-compliance, the purchaser who has signed the contract as a consumer will have the right to obtain the restoration of the conformity of the products without expenses, by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract in relation to the disputed assets and the consequent return of the price.
11. Withdrawal
In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the deadline of 14 days pursuant to Article 58 of Legislative Decree no. 206/2005 starting from the date of receipt of the products.
In the case of multiple purchases made by the buyer with a single order and delivered separately, the 30-day term begins on the date of receipt of the last product.
The purchaser who intends to exercise the right of withdrawal must inform Koinak Art Stock via an explicit declaration, which can be sent by registered mail to / from the address of the Koinak Art Stock office.
The purchaser must exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form (Annex I, part B, D lgs 21/2014)
The goods must be returned intact, in the original packaging, complete with all its parts and complete with the attached tax documentation.
Without prejudice to the right to verify compliance with the above, the site will reimburse the amount of products subject to withdrawal within a maximum period of 30 days, including any shipping costs.
The site will reimburse using the same payment method chosen by the purchaser at the time of purchase. In the case of payment made by bank transfer, and if the purchaser intends to exercise his right of withdrawal, he will have to provide the bank details: IBAN, SWIFT and BIC needed to make the repayment.
In case of exercise of the right of withdrawal, the Customer is required to return the goods within 14 days from the day in which he communicated to Koinak Art Stock his desire to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The goods must be returned to Koinak Art Stock at the address indicated on the site
The direct costs of returning the products are charged to the customer.
The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Koinak Art Stock will refund the amount of the products covered by the withdrawal within a maximum period of 30 days, including any shipping costs.
As foreseen by the art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Koinak Art Stock may suspend the reimbursement until receipt of the goods or until the customer demonstrates to have sent back the goods to Koinak Art Stock.
Koinak Art Stock will reimburse using the same payment method chosen by the Customer at the time of purchase. In the case of payment made by bank transfer, and if the Customer intends to exercise his right of withdrawal, he will have to provide Koinak Art Stock, by accessing the contact section, the bank details: IBAN, SWIFT and BIC necessary for the repayment, by of Koinak Art Stock.
12. Responsibility
Koinak Art Stock assumes no responsibility for disservices due to force majeure or unforeseeable circumstances, even if they are dependent on malfunctions and disruptions of the Internet, if it fails to execute the order within the time stipulated in the contract.
13. Access to the site
The Customer has the right to access the site for consultation and purchase. No other use, in particular commercial, of the site or its contents is permitted. The integrity of the elements of this website https://www.koinak.it, whether audio or visual, and the relative technology used remain the property of Koinak Art Stock and are protected by the intellectual property right.

16. Applicable law and competent court
These General Conditions of Sale are subject to Italian law.
Any dispute that does not find a friendly solution will be subject to the exclusive jurisdiction of the Court of the place of residence or domicile of the Customer, if located in the territory of the State.
